Terms and Conditions of Sale

Goods are only supplied on the following terms and conditions, unless they are varied in writing and signed by us:

1. Telephone Orders

We are willing to supply goods ordered by telephone, provided that in any disagreement between our and your understanding of the telephone order the former shall prevail. Accordingly please confirm the order in writing (clearly marked confirmation) quoting the official order number given to you on the telephone.

2. Price

Goods are sold at the price (subject to a minimum order value) current at the date of invoice.

3. Payment and Delivery

3.1 We will issue an invoice in respect of each delivery and payment in full is due within 30 days. 3.2 Each invoice will state a delivery address and date. Goods will be dispatched to the delivery address by a method of our choice. Special delivery may be at your request and expense, 3.3 We may withhold delivery if, on the dispatch date, any prior invoice is overdue and unpaid. 3.4 Late payment will incur interest of at least 8% above Natwest base rate from the date due.

4. Ownership of Risk

Goods remain our property until they are paid for but are at your risk from the time of receipt.

5. Claims

5.1 Claims for non-delivery of all or any of the invoiced goods must be made to us and the carrier in writing within a period of 14 days following the dispatch date; 5.2 Claims for defective goods must be made in writing within a period of 30 days following delivery. 5.3 Discrepancies of any kind will not be entertained unless notified in writing within 14 days of the date of invoice.

6. Cancellation and Return

Goods may only be returned by agreement but subject, at our discretion, to a handling charge.

In situations where orders have been placed and money has been taken, we reserve the right to charge a fee to cover our expenses should an order be cancelled prior to delivery to the customer.

7. Catalogues, Brochures and the Website

Information in catalogues and brochures may change without notice and we invite you to contact our technical sales department before placing orders. No Liability is accepted for the inaccuracy of published information.

Many of our product images are supplied to us by the manufacturers or distributors. We display them in good faith and while we make every effort to ensure they are accurate we have no control over discrepancies between the image and the item supplied.

8. Limited Liability

Any liability which we may incur to you in contract or tort ( including liability in negligence ) arising out of or as a result of:- 8.1 any failure to supply or deliver goods; 8.2 any delay in delivery of goods; 8.3 any defect in any goods or services; shall be limited to the purchase price of the goods in question. However, your statutory rights are not affected.

9. Liability to Third Parties

You shall indemnify us in respect of any liability and losses, costs, charges and expenses which we may suffer or incur by reason of any claim (including for liability in negligence) made by third parties in respect of or arising out of the state, conditions or use of goods (including, without limitations, goods resold to third parties whether or not dispatched directly to third parties at your request) or in any other way relating to the goods.

10. Force Majeure

We shall incur no liability for failure to perform our obligations hereunder due to the existence of circumstances which we have not caused and are beyond our control.

11. Pricing Errors and Changes

Prices quoted are correct at time of going to press, but may vary without further notice.

In the event of a pricing error, we reserve the right to cancel the order or remove the product with the error from the order. The customer will be notified of the error. A refund for the paid amount will be given. While we take care to eliminate these errors they do happen from time to time.

12. WEEE Regulations

The Waste Electrical and Electronic Equipment (or WEEE) Regulations are now U.K. law. All European member States including the U.K. have agreed to reduce the amount of WEEE that is being disposed of in landfill sites.

It is important that the amount of WEEE sent to landfill sites is reduced because:

  • Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste.
  • WEEE can contain hazardous substances. When left in landfill sites the hazardous substances in WEEE can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.

Distributors of new Electric and Electronic Equipment (or EEE) have a part to play in reducing the amount of WEEE going into landfill sites.

THESITEBOX.COM are “doing our bit” under these regulations by offering our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product.

For example, if a customer bought a new 12V Drill Driver from us we would accept their old 12V Drill Driver and prevent it going into a landfill site by disposing of it safely. Customers must return their WEEE item to us within 28 days of purchasing their new item. Customers do not have to pay for the transportation of their WEEE to our premises.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown below:

Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste.

13. The Waste Batteries and Accumulators Regulations

Under the Waste Battery Regulations, Tones Ties Ltd (THESITEBOX.COM) are now offering a take back scheme for all portable waste batteries, we will accept back replacement batteries as supplied, batteries have to be returned in person only during our opening hours, Monday to Friday 9am - 5.30pm. We will not accept batteries that are posted back so Do Not Post Old Batteries.

Alternatively, you can find your local waste portable battery recycling facility at www.recyclenow.com

Most supermarkets and shops that sell batteries will have collection bins for used batteries, and some town halls, libraries or schools may also set up collection points. End-users may find stores in their local area more accessible.

14. Giveaway Terms

We have some conditions associated with our giveaways, they are:

  • Open the UK residents only.
  • One per order.
  • Cannot be claimed in conjunction with any other offer. For example, if a discount coupon is used the coupon discount will prevail and no giveaway item will be supplied.
  • While stocks last.
  • We reserve the right to end a giveaway at any time.
